DEUTZ Connect App Terms of Use
The following terms of use apply for use of the DEUTZ Connect app operated by DEUTZ AG, Ottostr.1, 51149 Cologne.
1. Acceptance of Terms of Use
By accessing and using the DEUTZ Connect app, you declare yourself in agreement with these Terms of Use and consent to the data protection terms contained in these Terms of Use (see Clause 2 of these Terms of Use). You thus also consent to the processing of your personal data as specified in Clause 2. If you do not fully accept these terms of use, you may not use the DEUTZ Connect app. You declare your consent by pressing the “Accept” button on the “Terms of Use” view after exiting the DEUTZ Connect app welcome views.
2. Data protection declaration
2.1 Use of your data
DEUTZ AG collects and processes information about the use of functions within the DEUTZ Connect app. This helps identify the areas in the mobile app that are of particular interest to our customers. The purpose of data collection is the continuous improvement of the DEUTZ Connect app. We also process your data as specified in Clause 2.2 and Clause 2.3 for the purpose of maintaining customer relationships, increasing our product quality and optimising our service processes, as well as for internal marketing purposes. In addition, your data will be used by DEUTZ dealers (Clause 2.3) for their own purposes, and by the third parties specified in Clause 2.4 in accordance with the stipulations described in Clause 2.4.
If you do not agree to the aforementioned use, please do not accept these Terms of Use and terminate the installation, and/or remove the DEUTZ Connect app from your mobile device.
2.2 DEUTZ AG collects and stores log files and information which the DEUTZ Connect app sends to DEUTZ AG. These are:
Engine data (engine type, engine number, engine identification, operating hours, software version of the engine control unit, content of the engine control unit error log) and the following trip recorder data:
Control unit model, control unit serial number, control unit software version, assignment of series and exhaust gas system, control unit software, error log 1, engine number, load spectrum (3D overview diagram, battery voltage (2D overview diagram), maximum speed (2D overview diagram), oil pressure (3D overview diagram), load pressure (2D overview diagram), load pressure (3D overview diagram), load air temperature (2D overview diagram), ambient pressure (2D overview diagram), load air temperature (3D overview diagram), exhaust gas temperature (2D overview diagram), coolant temperature (2D overview diagram), injection pressure (2D overview diagram), injection control (2D overview diagram), ash accumulation, soot accumulation, exhaust gas pressure before burner (2D overview diagram), temperature at the SCR tank (2D overview diagram), exhaust gas temperature before the oxidation catalyst (3D overview diagram), exhaust gas temperature before the SCR system (3D overview diagram), exhaust gas pressure (2D overview diagram), engine number, certification number of the output level, engine series, data set ID for revision, engine speed, output, specification of the exhaust gas treatment system, battery voltage, operating software number, CAN number, certificate, data set number, EKZ number (assignment to series and exhaust gas system), engine output, engine speed, date of manufacture, speed controller number, business partner order number, business partner transport number, main certificate number, material number, material number, customer scope of delivery, monitoring function number, monitoring strategy number, order number, master data set number, transport customer scope of delivery, special app number, V1 data, V1 roof curve, V2 identification
Please note that the aforementioned data is automatically sent to DEUTZ AG every time your mobile device connects to the engine control unit. You can prevent this data transmission only by removing the DEUTZ Connect app from your mobile device.
2.3 In the event that you use the “SERVICE CONTACT” function, select a dealer location icon as displayed on a map and then select the “Send engine data” function. The DEUTZ Connect app will then also send the data specified in Clause 2.2 to the email address of the dealer you selected using the dealer location icon. The use of the function “Send engine data” also requires you to enter the following data: Name of your company, company email address, function (fleet operator, OEM [machine operator], Importer, Dealer, Workshop, Rental/Leasing, End-User). You can also enter free text. All of the above data (Clause 2.2, company name, company email address, function, free text) is sent to the dealer you have selected when using the “Send engine data” function.
If you select the “Photos” button under the “Find dealer” function, you can send up to two images, saved on your mobile device in the mobile device's image format, to the dealer in addition to the aforementioned information.
If you have allowed the DEUTZ Connect app access to your current geolocation, your location data (GPS coordinates) will also be sent to the dealer when using the “Send engine data” function.
DEUTZ AG will also receive all of the data you send to the dealer.
You can prevent the data transmission in accordance with Clause 2.3 by not selecting the “Find dealer” function.
2.4. Data collection and use of usage data by companies belonging to the Google Inc. corporation and LimeSurvey GmbH
2.4.1 The user behaviour of the DEUTZ Connect app within the main menu, Overview, My Devices, Diagnostics, Find Dealer and Dealer Contact functions (tapping buttons and selection of list entries) in the individual views is logged with the help of tools from Google Inc.
When the measurement data is exported, the 'answers' tool also logs the engine data, the number of transmitted images and the search term used when searching for a dealer.
The 'answers' tool logs the number of measurements performed and the number of generated PDF files and XML files.
It is possible to disable user behaviour logging in accordance with this Clause 2.4.1 at any time, by deactivating this option in the DEUTZ Connect app settings.
2.4.2 The DEUTZ Connect app automatically sends error notifications in the event that the DEUTZ Connect app crashes or stalls. This allows DEUTZ AG to examine the error and improve the stability of the mobile app in future versions. This data collection takes place directly via Google Inc., USA (https://firebase.google.com/docs/crashlytics). In the framework of these error reports, the DEUTZ Connect app sends information to Google Inc. about the model and version of the mobile device, the time at which the error occurred, the feature used and the status of the application when the error occurred. This includes, the current RAM capacity, the available disk space and the stack trace. DEUTZ AG receives an evaluation of the error notifications from Google Inc.. It is possible to disable crash report logging in accordance with this Clause 2.4.2 at any time, by deactivating this option in the DEUTZ Connect app settings.
2.4.3 You can participate in a survey by pressing the “Future e-Services” button in the DEUTZ Connect app. To carry out the survey in the DEUTZ Connect app, DEUTZ AG uses the LimeSurvey tool (https://www.limesurvey.org/de) from LimeSurvey GmbH, Umfragedienste & Beratung, Barmbeker Str. 7a, 22303 Hamburg, Germany. The purpose of the survey is to continuously improve the DEUTZ Connect app and the services described in the survey. The user declares his/her agreement that the responses may be used and published by DEUTZ AG in an aggregated format. In addition to the responses, during online communication within the framework of the survey, IP addresses, date and time of access, name and URL are also saved for the survey, the operating system and the browser used. This data is transmitted via an encrypted connection (https).
3. Right to delete and duration of storage
Your personal data are deleted when they are no longer necessary for the purposes for which they were collected or otherwise processed. Otherwise, you can exercise your rights under Art. 17 GDPR (“right to be forgotten") at any time.
4. General
The DEUTZ Connect app system does not enable the user to conclude a goods delivery contract with DEUTZ or a third party.
DEUTZ AG does not bear any liability in connection with the contract concluded between the potential user and the DEUTZ distributor, including in the event that the DEUTZ distributor provides an inadequate service.
Statutory regulations concerning the liability of DEUTZ pursuant to the law on liability for defective products (Product Liability Act - ProdHaftG) shall remain unaffected.
DEUTZ AG does not bear any liability for the completeness or accuracy of the information provided to the user in connection with the DEUTZ Connect app, nor does it bear any liability for this information being up to date. Furthermore, DEUTZ AG rules out any liability for the completeness and accuracy of the information provided to the user in conjunction with the DEUTZ Connect app, as well as any liability for this information being up to date. The same also applies particularly for all other websites that are accessed via hyperlinks. The operator bears sole responsibility for the content of linked websites. DEUTZ AG therefore rules out liability for the content of the linked websites. DEUTZ AG reserves the right to modify or supplement the information provided to the user in connection with the DEUTZ Connect app. Insofar as this information contains forward-looking statements, these statements represent assumptions by the Management of DEUTZ AG, which are subject to known and unknown risks and uncertainties. DEUTZ AG shall therefore not be liable for forward-looking statements.
DEUTZ AG does not assume any obligation to update forward-looking statements.
The liability exclusions and restrictions to the claims of the user in these terms and conditions shall not apply in the case of wilful intent, gross negligence by statutory representatives or managing staff members, nor in the case of culpable breach of significant contractual obligations. In the case of culpable breach of significant contractual obligations, DEUTZ AG accepts liability only for contractually typical, reasonably foreseeable damages – excluding in cases of intent and gross negligence by legal representatives or managing staff members.
The liability exclusions and restrictions to the claims of the ordering party in these terms and conditions also do not apply in cases where liability applies for personal injury or material damage to privately used objects according to the Product Liability Act, in the event of faults in the object supplied. The liability exclusions and restrictions also do not apply if defects have been fraudulently concealed or their absence has been guaranteed or if life, limb and health are culpably injured.
5. Trademarks and copyrights
All named brands listed in this app are the property of DEUTZ AG.
All of the information, documents or illustrations published in this app, including the design of this app are the sole property of DEUTZ AG. Any other reproduction, transfer or distribution is prohibited without express permission from DEUTZ AG.
6. Other regulations
DEUTZ reserves the right to discontinue the app in whole or in part, or make changes or updates to the app or its content at any time without prior notification.
In view of the nature of the Internet and computer systems, DEUTZ does not assume any warranty for the uninterrupted availability of the DEUTZ Connect app.
7. Online resolution of consumer disputes
We refer consumers, in accordance with § 13 BGB, to the following portal for alternative dispute resolution: ec.europa.eu/consumers/odr/
(Regulation (EU) No. 524/2013 on online dispute resolution for consumer disputes, for short: ODR Regulation.) DEUTZ AG is neither willing nor obligated to participate in a dispute resolution process before a consumer arbitration authority.
